Phoswift User Agreement

Dear User,

Welcome to Phoswift! Before you begin using our services, please CAREFULLY READ and FULLY UNDERSTAND the entire contents of this User Agreement (hereinafter referred to as the "Agreement"). Pay particular attention to the clauses involving your rights and obligations, as well as disclaimers, dispute resolution, and other clauses highlighted in bold, underline, or similar means. If you do not agree to any part of this Agreement, you should immediately cease accessing or using our services.

1. Acceptance and Modification of the Agreement

1.1 When you complete the registration or login process, or use the Phoswift software and related services (hereinafter referred to as the "Services") in any other manner, it signifies that you have fully read, understood, and accepted all terms of this Agreement. This Agreement thereby comes into full effect between you and the provider of Phoswift services.

1.2 We reserve the right to modify the terms of this Agreement from time to time within the limits permitted by law, based on business adjustments, technological updates, or changes in laws and regulations. The updated agreement will be posted on this page, and the update date will be adjusted accordingly. If material changes are made to the terms of this Agreement, we will notify you through reasonable means such as in-app notifications or website announcements. Your continued use of the Services after the effective date of such revisions indicates your acceptance of the updated Agreement.

2. Description of Services

2.1 Phoswift is a convenient mobile printing application that provides you with services including, but not limited to: connecting and managing printers, processing documents and images, accessing and using the built-in material library, editing templates, and completing printing tasks.

2.2 To realize the core printing functionality, the Services require you to authorize device permissions (such as Bluetooth, Local Network, Storage permissions) to connect to printers and access files. You understand and agree that if you refuse to provide the aforementioned necessary permissions, you will be unable to use related core functions such as device connection and file printing.

2.3 We reserve the right to change, interrupt, or terminate part of the service content based on actual operational circumstances, and will notify you in advance whenever possible.

3. Account Use and Security

3.1 You may need to register an account to use some features. You promise that the registration information you submit is truthful, accurate, and complete, and you are responsible for updating it promptly.

3.2 Your account is for your personal safekeeping. You are solely responsible for all activities conducted under your account (including, but not limited to, content uploads, printing operations, device management).

3.3 If you discover any unauthorized use of your account, you should notify us immediately. You understand that we are not responsible for any requests or operations performed on your account, unless such actions are directly caused by our gross negligence.

4. Code of Conduct

You agree to comply with the relevant laws and regulations of the People's Republic of China when using the Services and promise not to engage in, including but not limited to, the following acts:

4.1 Uploading, transmitting, storing, or printing any information containing the following content:

● Opposing the fundamental principles established by the Constitution;

● Endangering national security, divulging state secrets, subverting state power, or undermining national unity;

● Damaging national honor and interests;

● Inciting ethnic hatred, ethnic discrimination, or undermining national unity;

● Undermining state religious policies, promoting cults and feudal superstitions;

● Spreading rumors, disturbing social order, or undermining social stability;

● Spreading obscenity, pornography, gambling, violence, murder, terror, or abetting crime;

● Insulting or defaming others, infringing upon the lawful rights and interests of others;

● Containing other content prohibited by laws and administrative regulations.

4.2 Infringing upon any individual's or entity's intellectual property rights, trade secrets, or other proprietary rights.

4.3 Engaging in any activity that interferes with or disrupts the Services, servers, or networks connected to the Services, or attempting to circumvent any technological measures that restrict access or use.

4.4 Copying, modifying, decompiling, disassembling, reverse engineering any part of the Services, or using the Services for any commercial purpose without our explicit written permission.

5. Intellectual Property

5.1 We own the intellectual property rights, including copyrights, trademarks, and patents, to all content related to the Services, such as software, technology, trademarks, logos, interface design, and documentation (except where legally owned by a third party).

5.2 The intellectual property rights to the content you print, create, upload, or share through the Services remain with you or the relevant rights holder. You hereby grant us a worldwide, royalty-free, non-exclusive license to store, use, copy, and display such content for the purpose of providing, operating, promoting, and improving the Services to you.

5.3 The design elements provided by the Services, such as templates, materials, and fonts ("Licensed Materials"), are for your personal use only under the terms of this Agreement. You may not separately copy, distribute, resell, license, or use the Licensed Materials for any other commercial purpose.

6. Third-Party Services and Content

6.1 The Services may involve third-party hardware you connect to (such as printers) or third-party Software Development Kits (SDKs) you use. Such third-party services are independently provided by their providers and are governed by their own terms of service and privacy policies. We make no warranties regarding the availability, accuracy, or security of such third-party services.

6.2 You understand and agree that any disputes between you and any third-party service provider shall be resolved between you and that third party, and we assume no responsibility in this regard.

7. Disclaimer

7.1 THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

7.2 We shall not be liable for any service interruptions, data loss, printing errors, or other direct or indirect losses caused by force majeure (such as natural disasters, government actions, network service interruptions), computer viruses, hacker attacks, system instability, user operational errors, or any reasons beyond our control.

7.3 You are solely responsible for the legality and accuracy of all content printed through the Services. You shall bear all liabilities and legal responsibilities arising from the content you print and shall compensate us or any third party for all losses incurred as a result.

8. Subscription and Payment

8.1 Phoswift offers optional auto-renewable subscription plans (collectively, the "Premium Subscription" or "Membership") that unlock advanced features within the Services on both iOS and Android devices. By purchasing or subscribing to a Premium Subscription, you agree to the terms in this Section in addition to the rest of this Agreement.

8.2 Subscription Plans. We currently offer the following auto-renewable subscription options on supported platforms:

● Monthly Premium — a subscription with a billing period of one (1) month;

● Yearly Premium — a subscription with a billing period of one (1) year.

The specific subscription name, duration, and price are displayed on the in-app membership page at the time of purchase. Prices may vary by region, platform, and currency, and are subject to change in accordance with applicable laws and the policies of the applicable app store (Apple App Store or Google Play).

8.3 Premium Features. While your Premium Subscription is active, you may access premium features including, but not limited to: AI Filter, AI Art, AI Cutout, and premium templates and materials. We may add, modify, or remove specific premium features from time to time. Basic printing and non-premium features remain available without a subscription, subject to applicable usage limits.

8.4 Free Trial. From time to time, we may offer eligible new users a free trial period (currently up to three (3) days) for certain subscription plans. If you start a free trial, you will not be charged until the trial period ends. Unless you cancel at least twenty-four (24) hours before the trial expires, your subscription will automatically convert to a paid subscription and you will be charged at the price displayed at the time of purchase through the payment account associated with your app store account. Free trial eligibility is determined by the applicable platform provider (Apple or Google) and may be limited to one trial per account or subscription group.

8.5 Auto-Renewal. Premium Subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least twenty-four (24) hours before the end of the current period. Your account will be charged for renewal within twenty-four (24) hours prior to the end of the current period at the rate confirmed at the time of purchase or as otherwise notified by the applicable platform. The length of the renewal period will be the same as the original subscription period (monthly or yearly).

8.6 Effect of Cancellation or Expiration. If you cancel your subscription or if it expires for any reason (including failed payment), your access to premium features will end when the current paid period ends, unless otherwise required by law. After expiration, your account may revert to a basic (non-premium) membership level, and premium features may become unavailable or subject to usage limits. Cancellation takes effect at the end of the current billing period; you will not receive a refund for the unused portion of the current period except as required by applicable law or the policies of the applicable app store.

8.7 Price Changes. We may change subscription prices from time to time. If the price of your subscription increases, the applicable platform provider (Apple or Google) will notify you in advance where required, and you may need to accept the new price to continue your subscription after the current billing period.

8.8 iOS (Apple App Store). If you subscribe on an iOS device, the following terms apply in addition to the general terms above:

● Billing and Payment: Subscription payments are processed by Apple through your Apple ID account via In-App Purchase. We do not collect or store your payment card information. Your purchase is subject to Apple's applicable terms and conditions, including Apple's Media Services Terms and Conditions. By subscribing, you authorize Apple to charge your Apple ID account for the applicable subscription fee at the beginning of each billing period.

● Managing and Cancelling: You may manage or cancel your subscription at any time through your device's Settings: go to Settings > [Your Name] > Subscriptions, select Phoswift, and follow the on-screen instructions. You may also use the "Manage Subscription" option within the Phoswift app where available.

● Refunds: Subscription fees are billed by Apple. Refund requests must be submitted to Apple in accordance with Apple's refund policies. We do not process iOS subscription refunds directly. For refund assistance, please visit reportaproblem.apple.com or contact Apple Support.

● Restore Purchases: If you reinstall the app or use Phoswift on a new iOS device, you may restore an active subscription associated with your Apple ID by using the "Restore Purchases" option on the membership page, provided you are signed in with the same Apple ID used for the original purchase.

● Account: Your iOS subscription is linked to your Apple ID and is non-transferable. You are responsible for maintaining the security of your Apple ID and for all subscription activity associated with it.

8.9 Android (Google Play). If you subscribe on an Android device, the following terms apply in addition to the general terms above:

● Billing and Payment: Subscription payments are processed by Google through your Google account via Google Play Billing. We do not collect or store your payment card information. Your purchase is subject to Google Play's applicable terms and conditions, including the Google Play Terms of Service. By subscribing, you authorize Google to charge your Google account for the applicable subscription fee at the beginning of each billing period.

● Managing and Cancelling: You may manage or cancel your subscription at any time through the Google Play Store app: go to Google Play > Profile icon > Payments & subscriptions > Subscriptions, select Phoswift, and follow the on-screen instructions. You may also use subscription management options within the Phoswift app where available.

● Refunds: Subscription fees are billed by Google. Refund requests must be submitted to Google in accordance with Google Play's refund policies. We do not process Android subscription refunds directly. For refund assistance, please visit Google Play Help or contact Google Play Support.

● Restore Purchases: If you reinstall the app or use Phoswift on a new Android device, your active subscription associated with your Google account should be restored automatically when you sign in with the same Google account used for the original purchase. You may also use the "Restore Purchases" option on the membership page where available.

● Account: Your Android subscription is linked to your Google account and is non-transferable. You are responsible for maintaining the security of your Google account and for all subscription activity associated with it.

8.10 Cross-Platform Subscriptions. Subscriptions purchased through the Apple App Store and Google Play are managed separately by each platform and are generally not interchangeable. If you switch between iOS and Android devices, you may need to subscribe separately on each platform unless we explicitly offer and you use a cross-platform account linking feature within the app.

9. Privacy Protection

We highly value the security of your personal information. For details on how we collect, use, store, share, and protect your personal information, please refer to the Phoswift Privacy Policy. That privacy policy is an integral part of this Agreement.

10. Termination of the Agreement

10.1 You have the right to terminate your use of the Services at any time by permanently deleting the application from your mobile device, ceasing to visit our website, or notifying us explicitly.

10.2 If we reasonably believe that you have materially breached this Agreement, we have the right to suspend or terminate providing all or part of the Services to you immediately without prior notice, and reserve the right to pursue legal liability.

10.3 Termination of your use of the Services does not automatically cancel an active Premium Subscription. You must cancel your subscription separately through your Apple ID or Google account settings as described in Sections 8.8 and 8.9.

11. Governing Law and Dispute Resolution

11.1 The formation, execution, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the Mainland of the People's Republic of China.

11.2 Any dispute arising from or in connection with this Agreement shall first be resolved through friendly negotiation between the parties. If negotiation fails, either party has the right to submit the dispute to the competent people's court in the defendant's jurisdiction for litigation.

12. Miscellaneous

12.1 The headings in this Agreement are for convenience only and shall not affect the interpretation of any provision.

12.2 Our failure to enforce any right or provision of this Agreement concerning your or any other user's violation shall not constitute a waiver of such right.
